Service

The agreement between Smart Leak Locator and you, the customer, for pool leak detection and resurfacing services in Central Florida.

Last updated: 2026-07-15

1. Agreement

These Terms of Service ("Terms") govern the relationship between Smart Leak Locator ("we," "us," or "our") and you ("customer," "you," or "your") for pool leak detection, repair, resurfacing, and related services performed in Central Florida. By requesting our services, scheduling an appointment, or signing a service agreement, you agree to these Terms.

2. Services

We provide the following services in Central Florida (Orlando, Davenport, Kissimmee, Clermont, and surrounding areas):

  • Pool leak detection (electronic, pressure, dye, static testing)
  • Pool leak repair (plumbing, structural, equipment)
  • Pool resurfacing (plaster, Pebble Tec, NPT, CLI)
  • Pool tile repair and replacement
  • Pool deck resurfacing

Specific scope, pricing, and timeline for each project are documented in a written estimate or service agreement provided before work begins.

3. Estimates and Pricing

  • Free estimates: On-site assessments for tile repair, deck resurfacing, and resurfacing projects are free with no obligation.
  • Leak detection pricing: Pool leak detection starts at $375. Final price depends on pool size, plumbing complexity, and leak location. The detection fee is credited toward the repair if you hire us for the fix.
  • Written estimates: All repair and resurfacing jobs receive a written estimate valid for 30 days. Prices may change after 30 days due to material cost fluctuations.
  • Price match guarantee: We will match any comparable written quote from a licensed Florida pool contractor for the same scope of work. Competitor must be licensed, insured, and provide apples-to-apples material specifications.
  • Change orders: Any work outside the original scope requires written approval before proceeding. We will not perform additional work without your authorization.

4. Payment Terms

  • Deposit: Resurfacing and large repair projects may require a deposit (typically 30–50%) to schedule work and order materials.
  • Final payment: Due upon completion of work, before final walkthrough.
  • Accepted methods: Cash, check, credit card (Visa, MasterCard, Amex, Discover), ACH transfer.
  • Financing: Available through third-party lenders for qualified customers. Subject to credit approval.
  • Late fees: Invoices unpaid after 30 days accrue a 1.5% monthly late fee (18% APR). Accounts over 60 days past due may be sent to collections.
  • Returned checks: $35 fee for returned checks.

5. Warranties

5.1 Workmanship warranty

We warrant our labor against defects in workmanship for the following periods:

  • Pool resurfacing (labor): 2 years from completion date
  • Plumbing repairs: 1 year from completion date
  • Tile installation: 1 year from completion date
  • Equipment installation: 1 year from completion date

Workmanship warranty covers defects in installation, not damage from external causes (ground movement, water chemistry imbalance, freeze damage, improper maintenance, or acts of nature).

5.2 Manufacturer warranties

All warranties are provided through Smart Leak Locator and vary depending on the manufacturer of the materials used in the project (for example, PebbleTec and other manufacturers). The applicable warranty is included with the project estimate and is determined by the specific finish and materials selected for your renovation.

The following manufacturers are commonly used in our projects. Warranty coverage and duration vary by product and are confirmed in your project estimate:

  • Pebble Tec: Lifetime warranty on the material only (not labor or repairs) when Pebble Tec brand finish is installed. Registration with Pebble Tec is required within 30 days of installation. See pebbletec.com/warranty for full terms.
  • National Plasterers & Tile (NPT): Material warranty per NPT terms. Coverage does not include labor unless explicitly stated in the NPT warranty document.
  • CLI (Custom Liners International): Material warranty per CLI terms.
  • Equipment (pumps, filters, heaters): Per manufacturer warranty, typically 1–3 years. Warranty registration with the manufacturer is the customer's responsibility.

Warranty exclusions: Material warranties cover manufacturing defects only. They do not cover labor for removal and replacement, water chemistry damage, improper use, lack of maintenance, freeze damage, structural movement, or damage from natural disasters.

5.3 Warranty claims

To file a warranty claim, contact us at [email protected] with your project number, photos, and a description of the issue. We will respond within 5 business days to schedule an inspection.

6. Cancellation and Rescheduling

  • Customer cancellation: Free up to 24 hours before scheduled appointment. Less than 24 hours may incur a $95 trip charge.
  • Weather delays: We reserve the right to reschedule due to weather (heavy rain, lightning, freezing temperatures) for safety and material quality. We will reschedule at the earliest mutually convenient time.
  • Project cancellation after deposit: If materials have been ordered, customer is responsible for material costs plus a 15% restocking fee. Labor already performed is non-refundable.

7. Limitation of Liability

To the maximum extent permitted by Florida law:

  • Property damage: We are not liable for pre-existing conditions (cracks, weak substrate, hidden defects discovered during work). We will document and notify you immediately if we encounter any pre-existing condition that affects the work.
  • Consequential damages: Smart Leak Locator is not liable for any indirect, incidental, or consequential damages, including but not limited to loss of use, loss of revenue, water damage to property, or damage to landscaping.
  • Maximum liability: Our total liability for any claim is limited to the amount you paid for the specific service in question, or $5,000, whichever is less.
  • Water loss during leak detection: Some water loss is inherent in the leak detection process. We will minimize water loss to the extent practical but are not responsible for water bills during the detection period.
  • Pool water chemistry: Proper water chemistry is the customer's responsibility after service completion. We provide a written startup guide for resurfacing projects. Damage from improper water chemistry (low pH, high calcium hardness, etc.) is not covered by warranty.

8. Insurance and Licensing

  • Florida Certified Pool Contractor License # CPC1460764
  • General liability insurance: $1,000,000 per occurrence
  • Workers' compensation insurance for all employees
  • Bonded as required by Florida DBPR

Proof of insurance and licensing is available upon request.

9. Customer Responsibilities

You agree to:

  • Provide safe and reasonable access to the work area (clear deck, accessible equipment pad, secured pets).
  • Maintain proper water chemistry after service per the written startup guide.
  • Notify us promptly of any issues with the work performed.
  • Ensure pool equipment is in working order before service (unless we are replacing the equipment).
  • Pay invoices per the agreed terms.

10. Dispute Resolution

If a dispute arises, we encourage you to contact us first to resolve the issue informally. Most disputes can be resolved through direct communication.

If informal resolution is unsuccessful:

  • Mediation: Both parties agree to attempt mediation through a mutually agreed Florida mediator before pursuing litigation.
  • Jurisdiction: Any legal action must be filed in Polk County, Florida, or the county where the work was performed.
  • Governing law: These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
  • Statute of limitations: Any claim must be filed within 1 year of the date the work was completed, or within the period required by Florida law, whichever is shorter.

11. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to: natural disasters, severe weather, pandemics, supply chain disruptions, government restrictions, labor strikes, or utility failures.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via a banner on our website or, where appropriate, by email. Continued use of our services after changes constitutes acceptance of the updated Terms.

13. Entire Agreement

These Terms, together with any signed service agreement or written estimate, constitute the entire agreement between you and Smart Leak Locator. They supersede any prior oral or written agreements.
